More house news

To make this simple: Ken is our broker, Uday is the guy selling us the house in Waltham. Ken called yesterday to tell us that the person that owns the house in Arlington that Uday is buying died this week. They haven't lived in the house for a while (we get the impression that they were old, ill, and in a nursing home or something). Now Uday's lawyer and his seller's lawyer have to work out the legal logistics. Its seeming like he won't be able to close on his new house on June 16.
Ken says though this "shouldn't effect us". There is nothing in the P&S that allows him to get out of closing in Waltham on June 16 if he doesn't have a place to go - he'd need to get his stuff out, store it somewhere, and find a place to live until he could close on the new place. If he didn't want to do this basically, he'd need to just say "forget it, I'm walking away" and in that case we could sue him.
So *this* is why its been taking so long to figure things out - Uday wasn't getting back to Ken, so Ken wasn't getting back to us.
Heh, we'll see how this pans out. Its never a dull moment I tell you!

Date: 2004-06-09 05:25 am (UTC)Curiouser and curiouser! Can't wait to hear what happens, and fingers crossed that it doesn't affect the close...
Ken

Date: 2004-06-09 08:01 am (UTC)It's easy to think "Oh I'll call them tomorrow when I track down Mr. Foo" and then end up not being able to track him down all day and suddenly finding yourself 3 or 4 days out without an answer.

Date: 2004-06-09 08:34 am (UTC)Upon reading this, I just got annoyed because Ken could have just responded to J&B's first inquiry with "I left a message for the seller's agent, will let you know when he calls back" and the second with "I haven't received a callback, let me try them again". You know, just to give the impression of working on it. :)

Date: 2004-06-09 07:50 am (UTC)I totally agree. Its also very strange, because usually he's been good about communicating up until the last few weeks. We had no issues 2 years ago, and didn't have a lot of issues until the change in closing date happened a few weeks ago.
You'd think since he's making a lot of $ from us (commissions from 2 sales) he'd want to make efforts to make us comfortable. Ah well - I still am glad for the assistance he's given . . . we would never have gotten this house if it wasn't for him.
